exigencias legales y t\u00e9cnicas para el sector contact center"},"content":{"rendered":"\n<p>Con ocasi\u00f3n de la d\u00e9cima edici\u00f3n de los Desayunos de Negocio de GoContact que hace unas semanas tuvo lugar en Madrid, los asistentes tuvimos oportunidad de comentar algunas de las principales novedades jur\u00eddicas que nos aguardan para este 2023 en el apasionante mundo del contact center y que pueden ser de inter\u00e9s exponer por aqu\u00ed.&nbsp;<\/p>\n\n\n\n<p>Por ejemplo, cumplidos los primeros seis meses de vigencia de la nueva Ley General de Telecomunicaciones (Ley 11\/22, de 28 de junio), nos encontramos con que cada vez le queda menos tiempo (concretamente, hasta el pr\u00f3ximo 29 de junio de 2023) a la muy particular disposici\u00f3n final sexta de la Ley que postpone hasta entonces el \u201c\u00bfnuevo?\u201d <strong>derecho de los usuarios finales a no recibir llamadas no deseadas con fines de comunicaci\u00f3n comercial<\/strong> (salvo consentimiento de los usuarios u otra base de legitimaci\u00f3n).&nbsp;&nbsp;<\/p>\n\n\n\n<p>Y este aspecto (la creaci\u00f3n de un derecho -\u00bfQu\u00e9 acaso no se ten\u00eda ya?-de aplicabilidad postergada) adem\u00e1s de dar una falsa y peligrosa sensaci\u00f3n de temporal seguridad jur\u00eddica hasta finales de junio para pr\u00e1cticas claramente contrarias a la Ley, ha escondido un segundo hecho que merece ser puesto de relevancia: que el incumplimiento del mismo no solo dar\u00e1 lugar a sanciones por el incumplimiento de la LOPDGDD (y RGPD) sino tambi\u00e9n por el propio incumplimiento de la misma Ley General de Telecomunicaciones, siendo en todos los casos la Agencia Espa\u00f1ola de Protecci\u00f3n de Datos quien ostentar\u00e1 la potestad sancionadora.&nbsp;<\/p>\n\n\n\n<p>Una Agencia Espa\u00f1ola de Protecci\u00f3n de Datos de la que estuvimos comentando su \u00faltima memoria y que lidera, con gran diferencia, el ranking de las autoridades de control en Europa con mayor n\u00famero de sanciones impuestas, con m\u00e1s de 14.000 procedimientos\/expedientes abiertos en el \u00faltimo a\u00f1o y que, en sus propias palabras, \u201c<em>ha tenido un significativo incremento, de m\u00e1s del 90% con respecto al a\u00f1o 2020, de las reclamaciones relacionadas con la promoci\u00f3n publicitaria (<\/em>de las que<em>) el 70% se refer\u00edan espec\u00edficamente a la recepci\u00f3n de llamas telef\u00f3nicas no deseadas<\/em>\u201d.&nbsp;<\/p>\n\n\n\n<p>Con todos estos antecedentes, la previsible aprobaci\u00f3n del Proyecto de Ley por el que se regulan los servicios de atenci\u00f3n a la clientela (la eufem\u00edsticamente conocida como \u201cley de los 3 minutos\u201d) fue asimismo objeto de an\u00e1lisis, destacando como, seg\u00fan dispondr\u00eda su art\u00edculo 4.7,&nbsp; <strong>deber\u00e1n ser las empresas quienes tendr\u00e1n que asumir la carga de la prueba del cumplimiento de las obligaciones impuestas por dicha ley <\/strong>(plazos de atenci\u00f3n, sistemas de accesibilidad, justificantes de las operaciones realizadas, evaluaci\u00f3n del sistema de atenci\u00f3n, etc.), <strong>un compromiso de marcado car\u00e1cter t\u00e9cnico con el que los proveedores de soluciones para contact center adquieren un renovado
